The federal appeals court has maintained a prohibition on deploying state troops in the Oregon city, following a recent legal decision.

Judicial Panel Agrees to Rehear Case

The ninth circuit court of appeals decided on this week that it would reexamine the case concerning the executive power with an expanded group of 11 judges. The court also overturned a previous ruling from a smaller judicial group that had supported the federal government.

Legal Saga Over Troop Deployment

This legal directive represents the most recent development in a protracted legal battle over whether the former president has the authority and justification to deploy national guard forces in the city. Approximately two hundred troops have been in limbo since late September when the mobilization attempt was initiated in due to ongoing demonstrations.

Conflicting Arguments

The administration has argued that government employees at the ICE facility in south Portland were under attack, while city and state officials maintain that local officers have control of the situation.

Contrary to characterizations of Portland as a conflict zone, residents have been posting videos of scenic paths and a thriving food scene, and planning events such as an protest bicycle event against the “militarization of our city”.

Court Proceedings

The Tuesday ruling came after a US district judge in the city issued two temporary restraining orders this month – one blocking the federal control of the state troops, and another stopping the use of any national guard troops in the state, after efforts to circumvent the initial injunction by mobilizing out-of-state forces.

On Monday, the ninth circuit panel had put the first ruling on hold – allowing command of state troops – but the subsequent injunction stayed effective, preventing the actual deployment of the troops.

Full Panel Consideration

The latest ruling means the issue will be heard “en banc” – with all decisions under review simultaneously – by a group of eleven justices.

“This ruling demonstrates that the truth matters and that the judicial system are working to ensure government responsibility. The constitution restricts the executive authority, and Oregon’s communities cannot be treated as a training ground for unchecked federal authority,” said the state attorney general in a statement.

“The judicial body is sending a clear message: the president cannot send the military into US cities unnecessarily. We will continue defending state legislation, principles, and autonomy as this legal proceeding progresses and our fight continues in the judicial system.”
